WRITS TYPES (FUNDAMENTAL RIGHTS)

HABEAS CORPUS-

It is a Latin term which literally means 'to have the body of '. It is an order to a person who has detained another person,to produce the body of the latter before it. The writ of habeas corpus can be issued against both public authorities well as private individuals.

MANDAMUS-

It literally means 'we command .' It is a command issued by the court to a public official asking him to perform his official duties that he has failed or refused to perform.

PROHIBITION-

Literally,it means 'to forbid'. It is issued by a higher court to a lower court or tribunal to prevent the latter from exceeding its jurisdiction or usurping a jurisdiction that it does not possess.

CERTIORARI-

In the literal sense, it means 'to be certified' or 'to be informed'. It is issued by a higher court to a lower court or tribunal either to transfer a case pending with the latter to itself or to squash the order of the latter in a case.

QUO- WARRANTO-

In the literal sense, it means 'by what authority or warrant'. It is issued by the court to enquire into the legality of claim of a person to a public office. Hence, it prevents illegal usurpation of public office by a person.

अकेलापन लगता है बरसों से कोने में अकेले पड़ी हूं यह नीरस हृदय का खालीपन गुमसुम सी दीवार और मेरा चीखता मन गूंजता है कानों में।। कभी मोबाइल, कभी खिड़कियों पर कभी बालकनी में राहों पर टकटकी लगाए सुबह से शाम हो जाती है। जहां किसी के लौटने का इंतजार नहीं किसी को मुझ तक पहुंचने की जल्दबाजी नहीं। घड़ी की टिक-टिक की आवाज और सजे-धजे कमरे जहां सिलवट पड़ते ही नहीं। नींद कोसों दूर है यह सूनापन,अकेलापन इतनी व्यस्त दुनिया में जहां मेरे खालीपन की कोई जगह नहीं।। By Pallavi Mishra
